The former personal attorney for Donald Trump has stepped down as New Jersey's top federal prosecutor. This comes after a judicial decision that questioned her legal standing to serve.
The nation's top law enforcement official, the Attorney General, announced the prosecutor's departure on the start of the week. In a statement that the judicial decision made it impossible for her to perform her duties.
"Do not interpret compliance for surrender," she wrote. "This battle will now reach across the nation."
Habba's exit comes a week after a judicial panel found that she had been acting without proper authority as the top prosecutor. This decision is likely to affect scores of legal proceedings in the Garden State.
The court ruled that a temporary posting that skirted confirmation by the US Senate violated the federal law governing appointments.
It was also stated that Habba will remain at the DOJ as a top consultant. They intend to pursue additional appeals of the court's action, aiming for a overturned decision.
Writing online, the Attorney General contended that judges "cannot be permitted to countermand the President's choice of attorneys entrusted with executing the primary duty of the administration of enforcing the law."
The attorney general praised her tenure and said that during her run, the city of Newark saw a 20% reduction in offenses. She also stated that the Camden had its first summer in 50 years without a homicide.
Habba, originally became part of Trump's personal legal team in 2021. She went on to represented her client in his hush-money trial in 2024, which resulted in his conviction on multiple felony counts of falsifying business records.
Before Habba took on the top New Jersey post, Donald Trump had revealed he was naming her as his White House advisor if re-elected, labeling the lawyer as deeply loyal and a "tireless advocate for justice".
